Orders will be shipped by courier service to the delivery address freely chosen by the user. The delivery period will be counted from the day after the contract is entered into and/or payment made and will vary depending on the type of product acquired and the delivery area. OREKA TRAINING will not accept any liability if the product is not delivered as a consequence of inaccurate or false data submitted by the user for this purpose, as well as in scenarios in which the delivery cannot be made due to absence of the recipient. In such case, the user may opt to pay the shipping costs of a second attempt to ship, or to collect the order in person at the premises of OREKA TRAINING.
In the event the contract cannot be fulfilled due to unavailability of the product contracted, OREKA TRAINING will inform the User of this lack of availability.
In this case the customer is entitled to a refund without undue delay of the sum paid in virtue of the contract.
Price and postage costs
The prices indicated for each product include value added tax (VAT), except when expressly indicated otherwise. The prices and currencies shown to the Users will vary depending on their geographic location, which will be determined automatically from the IP address from which they access the website (United Kingdom: Pound Sterling; the rest of the European Economic Area and South Africa: Euro; the rest of the world: US dollar). Except when expressly indicated otherwise, these prices do not include the shipping costs, shipping insurance or any other services in addition to the product or service acquired.
The postage costs that must be paid by Users in mainland Spain are the following, although the shipping costs of your order will be viewed during its processing:
- For products weighing less than 10 kg, the shipping costs are €20.
- For products weighing between 10 and 50 kg, the shipping costs are €60.
- For other products weighing more than 50 kg, the shipping costs are €100.
Payment methods permitted
OREKA TRAINING accepts the STRIPE payment platform and payment by bank transfer.
Online payment with credit or debit cards is through a secure system that encrypts the user’s bank details when they are transmitted via the Internet.
Invoicing
The User knows and accepts that OREKA TRAINING will only send invoices to the email address provided during the registration process.
Nevertheless, the user can at any time request that the invoice be sent on paper. To do so, send your request to info@orekatraining.com.
Right of cancellation
The User has the right to cancel the contract entered into via the OFFICIAL OREKA TRAINING PAGE within 14 days.
To be classed as within the cancellation period, the communication related to the User’s wish to exercise this right should be sent before the corresponding period ends.
To exercise the right to cancellation, the User must notify OREKA TRAINING of their decision to cancel the contract by means of an unequivocal declaration (for example, a letter sent by post, fax or email).
In the case of a sales contract, the cancellation period will expire 14 calendar days from the day on which the user or a third party indicated thereby, other than the courier, has taken material possession of the goods.
Consequences of cancellation
In the event of cancellation, OREKA TRAINING will refund all payments received from the User, including shipping costs (except additional costs resulting from the User’s choice of a delivery method other than the cheapest ordinary delivery method we offer) without undue delay and, in any event, no later than 14 calendar days from the date on which the User informs OREKA TRAINING of their decision to cancel the contract. OREKA TRAINING will make this refund using the same payment method used by the User for the initial transaction, unless they expressly state otherwise; in any event, the user will not incur any costs as a consequence of the reimbursement. OREKA TRAINING may retain the refund until they have received the goods.
The User must return or directly deliver the goods to OREKA TRAINING, without undue delay and, in any event, no later than 14 calendar days from the date on which they communicate their decision to cancel the contract. The term will be deemed to have been met if the User returns the goods before this period ends. The User must assume the direct cost of returning the goods, unless the file of the specific product acquired specifies otherwise.
The User will be liable for the decrease in value of the goods resulting from handling other than that necessary to establish the nature, characteristics and functioning of the goods.
Based on the above paragraph, the goods must be returned without defects and with all their components, INCLUDING THE ORIGINAL PACKING FOR THEIR CORRECT TRANSPORT.
If the right to cancellation is not exercised.
In accordance with article 103.m) of Royal Legislative Decree 1/2007, of 16 November, which approves the rewritten text of the General Law for the Defence of the Consumers and Users and other complementary laws, the User may not cancel a contract for the supply of digital content not provided in material format, when the execution has begun with express prior written consent of the User with knowledge that they will consequently lose their right to cancellation.
Complaints, claims and requests for information
The User can direct their complaints, claims or requests for information to OREKA TRAINING’s customer support services by sending an email to the address info@orekatraining.com.
OREKA TRAINING will respond to the complaints received as quickly as possible and in any event within a maximum of one month of the complaint being lodged.
Delivery terms / Force majeure
The shipping and delivery terms are provided for informational purposes only and are not binding. Oreka Training shall not be held responsible for any ban, fault, failure or delay in the manufacture or delivery that may be caused by sabotage, fire, flood, explosion, labour dispute, strike, work stoppage, unrest, insurrection, war, acts or priorities required for the direct or indirect benefit of any government body, authority or agency, shortage of raw materials or supplies, unforeseen circumstances, insufficient capacity, or any other cause that is beyond the control of Oreka Training. If any of these bans, faults, interruptions or delays should arise, Oreka Training may, at their discretion, extend the delivery period or cancel the order, fully or in part.
In no case may Oreka Training be liable for any special, incidental damage, indirect or consequential, including, but not limited to loss of profit, loss of activity, savings, business, customers, data of any type, complaints from third parties or occupational complaints that result in any type of fault or delay in the delivery. Oreka Training will have the right to proceed with partial deliveries. The purchaser is responsible for providing an accurate delivery and collection address for the items.
